“Night in Nashville” Giveaway Contest Rules & Regulations

By participating, each participant agrees as follows:

1. NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED. ALL FEDERAL, STATE, AND LOCAL REGULATIONS APPLY. Any attempted form of entry into the Contest other than as described herein is void.

2. Eligibility. This Contest is open only to legal U.S. residents who are age 18 or older at the time of entry. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3. Contest Period. The Contest will begin at 9:00 am CT on June 26, 2024 and will run through 11:59 pm CT on July 8, 2024 (the “Contest Period”). The Sponsor’s computer is the official time keeping device for this Contest.

4. How to Enter. Participants can visit the website https://www.thefishercenter.com/newsletter/  and fully complete the Email Sign Up Form by (a) providing email and (b) providing first and last name. Participants automatically will receive one (1) entry into the Contest. Participants must successfully submit the Email Sign Up Form no later than 11:59 pm CT on July 8, 2024 to receive a valid entry. Sponsor is not responsible for lost, late, incomplete, invalid, inappropriate, or misdirected entries, all of which will be disqualified. All potential winners are subject to verification before any prize will be awarded.

Limit: Each entrant may enter the Contest one (1) time during the Contest Period. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant’s entries and that entrant may be disqualified.

5. Winner Selection. On July 9, 2024, Sponsor will select one (1) entry for the Prize (as defined below) in a random drawing from among all valid entries. The winning entrant will be contacted using the email address used to submit the entry and may be awarded the prize (subject to verification of eligibility and compliance with the terms of these rules.) Sponsor’s decisions as to the administration and operation of the Contest and the selection of the potential winner is final and binding in all matters related to the Contest. Failure to respond to the initial verification contact within seventy-two (72) hours of notification will result in disqualification. If a potential winner cannot be contacted or if the prize or prize notification is returned as undeliverable, potential winner forfeits the prize. In the event that a potential winner of a Contest prize is disqualified for any reason, Sponsor may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. There will be three (3) alternate drawings after which the prize will remain un-awarded. 

6. Prize. One (1) Prize will be awarded in this Contest. The Prize awarded on July 9 consists of two (2) tickets to a single show at The Fisher Center at Belmont University, a $50 gift card to Chago’s Belmont Cantina, and one night’s stay at the Hilton Garden Inn Nashville West End. The winner may select the show of their choice that takes place in 2024 and is on sale at the time of the Contest, subject to availability. Eligible shows include Brit Floyd on July 13, Nashville Dance Festival on July 19, A Celebration of Jazz Starring Boney James on August 4, One Vision of Queen feat. Marc Martel on September 6, Beth Hart on September 13, Comedy Night with Jeff Allen & Stephen Bargatze on October 11, MANIA: The ABBA Tribute on November 2, Wheel of Fortune LIVE! on November 7, NUTCRACKER! Magical Christmas Ballet on December 13, or Michael W. Smith Every Christmas on December 20 or 21. All costs, fees, and expenses associated with a prize or the acceptance and use of any element of a prize are the sole responsibility of the winner and are subject to all applicable federal, state, and local laws, rules, and regulations.

Odds of winning the Prize depend on a number of factors including the number of eligible entries received during the Contest Period.

There is no substitution, transfer, or cash equivalent for the Prize. The Prize is expressly limited to the item(s) listed above and do not include taxes, gratuities, or any other expenses. The tickets awarded as part of the Prize will be subject to the terms and conditions set forth by the issuer and are valid only on the date(s) printed on the tickets. Other restrictions may apply.

Should a winner be unable to travel to the Fisher Center at Belmont University for any reason, winner immediately forfeits the Prize and at that time, Sponsor may select an alternate winner in its sole and exclusive discretion and in compliance with these Contest Rules.

Prize is non-transferable and no substitution will be made except as provided herein in the Sponsor’s sole discretion. All elements of the Prize must be redeemed at the same time, and no changes will be permitted after confirmation of any redemption.

If the Prize or a portion of the Prize is postponed, cancelled, or otherwise unavailable due to disease, epidemic, pandemic, quarantine, any acts of government and/or any reason that is beyond the control of the Sponsor, then no substitution shall be provided. The Sponsor makes no representation or warranty about the safety of any prize. By accepting and using a prize, each winner acknowledges and assumes all risks of accepting and using the prize, and any other risks associated with the prize.

Tickets for events may not be re-sold for profit online or off. All tickets given away by The Fisher Center are for promotional use only. Reselling tickets can result in winner being banned from all future station contests, or other legal action.

7. Entry Conditions and Release. By entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor, which are binding and final in all matters relating to this Contest; (b) release and hold harmless Sponsor, The Fisher Center at Belmont University and Belmont University, and its subsidiaries, and affiliated companies, participating sponsors, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest, and each of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Contest, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to an entrant’s participation in the Contest and/or entrant’s acceptance, use, non-use or misuse of the prize.

8. Publicity. Except where prohibited by law, participation in the Contest constitutes winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

9. Taxes. All state, local, federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner.

10. General Conditions. Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

11. Limitations of Liability. The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use, non-use or misuse of any prize. No more than the stated number of prizes will be awarded. In event that a production, technical, programming or other error causes more than stated number of prizes as set forth in these Official Rules to be claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.

12. Changes to the Contest. If, for any reason, in the sole opinion of Sponsor, this Contest is not capable of running as planned by reason of an Act of God, disease, epidemic, pandemic, quarantine, acts of government, infection by computer virus, worms, bugs, tampering, hacking, unauthorized intervention, fraud, technical failures, system overload or any other causes, whether discovered or suspected by Sponsor, which, in the sole opinion of the Sponsor, does or could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend this Contest, and/or provide alternative means of entry or any other changes to these contest rules that Sponsor deems appropriate under the circumstances. In the event of termination, suspension or modification of this contest, a notice will be posted online.

13. Disputes. Except where prohibited, entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, other than those concerning the administration of the Contest or the determination of the winners, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate Tennessee Court; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Tennessee, without giving effect to any choice of law or conflict of law rules (whether of the State of Tennessee or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Tennessee.

14. Entrant’s Personal Information. Information collected from entrants is subject to Sponsor’s Privacy Policy, which is available on the Belmont University Website Privacy Policy link. All entry blanks, forms, devices, and materials gathered during the course of entry, as well as all information contained on or within, shall become the sole property of Sponsor to be used, disposed of or destroyed in its sole discretion. Sponsor is not responsible for any incorrect or inaccurate information entered by email users, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the Sponsor’s websites.
